Overview
These Terms of Service ("Terms") govern your access to and use of [https://www.glaxaura.com] and any purchase from GlaxAura™. The Site and related services are referred to collectively as the "Services."
By visiting the Site, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy, Refund and Return Policy, and Shipping and Delivery Policy. If you do not agree, do not use the Services.
Eligibility
You must be at least the age of majority in your province, territory, or state and legally capable of entering a contract to place an order. Products intended for children's rooms must be purchased and set up by an adult.
Store platform
Our store is hosted by Shopify, which provides the e-commerce platform that allows us to offer products and Services. Your purchase is from GlaxAura™, not Shopify.
Acceptable use
You may not use the Site or Services:
- for an unlawful, fraudulent, abusive, or harmful purpose;
- to violate intellectual-property, privacy, publicity, or other rights;
- to transmit malware or interfere with Site security or operation;
- to scrape, copy, reverse engineer, or exploit the Services except as permitted by law; or
- to place false, unauthorized, or fraudulent orders.
We may restrict or terminate access where reasonably necessary to protect the Services, customers, GlaxAura™, or others.
Product information
We try to present product descriptions, photographs, dimensions, colours, included components, pricing, and availability accurately. Screen settings, room lighting, wall colour, projection distance, focus, slide choice, and environmental conditions may affect how projected images appear. Lifestyle photographs and projected scenes are illustrative and should be reviewed together with the written product specifications.
We may correct genuine errors or update product information. If a material error affects an order already placed, we will contact you and provide options required by applicable law.
Orders and acceptance
Submitting an order is an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily mean that the order has been accepted. We may reject or cancel an order for legitimate reasons, including suspected fraud, payment failure, pricing error, inventory unavailability, shipping restriction, or violation of these Terms.
If we cancel an order after payment, we will refund the cancelled amount to the original payment method. We may limit quantities where reasonably necessary, provided we do not unlawfully discriminate.
Prices, currency, and taxes
Prices and available currencies are displayed on the Site. Applicable taxes and any non-standard delivery charges will be shown before checkout where required. Currency conversion or foreign-transaction charges imposed by your bank or payment provider are your responsibility.
Payment
You represent that the payment information you provide is accurate and that you are authorized to use the selected payment method. Payment processing is subject to the terms and privacy practices of the payment provider.
Shipping, returns, and refunds
Shipping, delivery, cancellations, returns, and refunds are governed by the policies posted on the Site and incorporated into these Terms. If a conflict exists, mandatory law controls.
Product use and safety
Use GlaxAura™ products only as described in the instructions supplied with the product. Use a compatible power source, keep the product dry, provide adequate ventilation, and do not look directly into the illuminated lens. Adult supervision is recommended when the product is used by or near children. Stop using a product that appears damaged, overheats, emits an unusual smell, or has an unsafe cable or connector.
The product is intended for decorative ambient projection and is not a medical device, scientific instrument, or substitute for professional lighting or sleep treatment.
Intellectual property
The Site and its content—including the GlaxAura™ name, logos, graphics, photographs, videos, copy, designs, and arrangement—are owned by or licensed to GlaxAura™ and protected by applicable intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable right to access the Site for personal, non-commercial shopping use.
No content may be copied, reproduced, modified, distributed, sold, or commercially exploited without prior written permission, except as permitted by law.
Reviews and user content
If you submit a review, photograph, video, testimonial, or other content, you confirm that you own or have permission to submit it and that it is truthful, lawful, and does not violate another person's rights.
You grant GlaxAura™ a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, and display that content for operating and promoting the Services, subject to applicable privacy law and any separate consent we request. We may decline or remove content that is fraudulent, unlawful, abusive, irrelevant, or violates these Terms, but we will not suppress a genuine review solely because it is negative.
Third-party services and links
The Services may contain links to or integrations with third-party services. We do not control and are not responsible for third-party content, availability, terms, or privacy practices. Your use of a third-party service is governed by its own terms.
Service availability and changes
We may modify, suspend, or discontinue parts of the Services. We will not make changes retroactively to deprive you of rights relating to an order already accepted, except where legally required or agreed with you.
Disclaimer of warranties
To the fullest extent permitted by law, the Site and Services are provided on an "as is" and "as available" basis. We do not guarantee that the Site will always be uninterrupted, secure, or error-free.
This disclaimer does not exclude or limit any statutory warranty, condition, guarantee, or other consumer right that cannot legally be excluded or limited. Any product warranty or remedy will be provided as stated in our policies and as required by applicable law.
Limitation of liability
To the fullest extent permitted by law, GlaxAura™ will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the Services, including lost profits or lost data, where such exclusion is lawful.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, gross negligence, personal injury caused by negligence, breach of mandatory consumer rights, or any other liability that cannot legally be excluded or limited.
Where liability may lawfully be limited, GlaxAura™'s aggregate liability arising from a product order will not exceed the amount paid for the product giving rise to the claim. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
Indemnification
To the extent permitted by law, you agree to indemnify GlaxAura™ against third-party claims, losses, and reasonable costs arising directly from your unlawful misuse of the Services or your material violation of these Terms. This section does not apply to ordinary consumer use and does not limit any non-waivable consumer right.
Governing law and disputes
These Terms are governed by the laws and the federal laws of Canada applicable there, without regard to conflict-of-law principles.
Before beginning a formal claim, you and GlaxAura™ agree to make a reasonable attempt to resolve the issue by contacting support@glaxaura.com. If the issue is not resolved, claims may be brought before a court or tribunal with lawful jurisdiction.
Nothing in these Terms prevents a consumer from relying on mandatory rights or bringing a claim in a forum available under the consumer-protection laws of the consumer's province, territory, or state.
Changes to these Terms
We may update these Terms from time to time. The revised Terms apply from the date posted and will not retroactively change an accepted order unless permitted by law and clearly communicated.
Severability and waiver
If any provision is found unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.
Entire agreement
These Terms and the policies incorporated by reference form the entire agreement between you and GlaxAura™ concerning the Services, except for any additional written terms that apply to a specific promotion or product.
